Domain names cannot be replicated. If one is taken, the only recourse would be to approach the owner to discuss a sale. How will this new framework for refundable taxes impact the real estate environment? Well, given that refundable taxes apply in respect of CCPCs only, this new regime will not affect the foreign pension funds, public corporations or tax-exempt entities investing in real estate in Canada. The new regime will also not impact CCPCs that retain their profits within the corporation instead of distributing them to their individuals nor will it impact CCPCs that earn pure active business income or pure passive investment income. Instead, these measures will affect CCPCs accumulating profits from both active business income and passive income and paying these profits out to their individual shareholders.
Self Publishing is mainstream today. When you purchase an eBook off of Amazon there’s a pretty good chance you’re buying a self-published book. Self-publishing is also ridiculously easy. I tried this a few years ago and couldn’t believe how simple the process was. To self-publish a book you’ll first need to write and edit it, create a cover, and then upload to a program such as Amazon’s Kindle Direct Publishing. Don’t expect instant success though. There will need to be a lot of upfront marketing before you can turn this into a passive income stream.
To save time and effort, a person can group two or more of their passive activities into one larger activity, provided they form an "appropriate economic unit." When a taxpayer does this, instead of having to provide material participation in multiple activities, they only have to provide it for the activity as a whole. Active participation isn’t the same as material participation (defined later). Active participation is a less stringent standard than material participation. The activity is a significant participation activity, and you participated in all significant participation activities for more than 500 hours. A significant participation activity is any trade or business activity in which you participated for more than 100 hours during the year and in which you didn’t materially participate under any of the material participation tests, other than this test. According to Derek Wagar, a Tax Partner at Fuller Landau LLP in Toronto, if an investor is considering selling certain investments at a profit in the near future, it may make sense to trigger those gains gradually over several years (to the extent possible) as the new passive income rules come into effect in 2019 (based on 2018 passive income). Spreading out gains across tax years may allow your CCPC to preserve more of its SBD limit in future years.
The current laws don’t really distinguish between active and passive income. Since passive income is already taxed at a lower rate, companies can use dividends as a way to gain a tax advantage by paying dividends out of active (and lower-taxed) income rather than passive income. Business owners will now have to prove they’re paying dividends out of investment income, which will make it more difficult to game the system by getting a double deduction on lower-taxed dividends. Some business owners use dividends as a method of retirement savings. If your small business clients get their household income from dividends, talk to them about alternative strategies, such as setting up payroll and switching to a salary. While salaries are taxed at a higher rate, they’re also helpful for retirement savings as they involuntarily trigger Canada Pension Plan contributions.
