More good news. The LLC’s activities are considered self-rental activities which means that you are creating a transaction with yourself. Low Income Taxpayer Clinics (LITCs) are independent from the IRS. You must file a written statement with your original income tax return for the tax year in which you regroup the activities. The statement must provide the names, addresses, and EINs, if applicable, for the activities that are being regrouped. If two or more activities are being regrouped into a single activity, the statement must contain a declaration that the regrouped activities make up an appropriate economic unit for the measurement of gain or loss under the passive activity rules. In addition, the statement must contain an explanation of the material change in the facts and circumstances that made the original grouping clearly inappropriate.


Many entrepreneurs are asking if the new rules will result in them paying additional taxes if their corporations generate passive income in excess of $50,000. Investors turn to real estate as a way to build long-term wealth, earn additional income, and generate a tax shelter. Using real estate as a tax shelter that extends to other income can be a complicated process. Knowing how you can use any losses generated by your rental real estate starts with understanding how the IRS defines and treats passive and active income.


A good portion of my stock allocation is in growth stocks and structured notes that pay no dividends. The dividend income that comes from stocks is primarily from S&P 500 index exchange-traded funds. Another common way to earn passive income is to invest in real estate. This does involve some hefty investment on your part to get started, though, since real estate doesn’t come cheap. The goal is to earn enough back by renting out the property to not only cover your original investment, but to also turn a profit. Keep in mind that similar to letting your room through Airbnb, this venture may require some time and money to maintain. Plus, you will have to rely on others and tenants to keep the property in good shape.

If the property in the syndication was held for at least a year, the gain will be treated as long term capital gain subject to 15%/20% capital gains rate.  Any depreciation taken on the property is subject to recapture and taxed at 25%.  The issuance of a K-1 usually results in a taxpayer needing to extend their individual tax return as most K-1s are not sent out until after the regular due date April 15.
The PPACA Medicare tax is a dangerous tax IMHO. It is an entirely new kind of tax. It is small and in jeopardy of going away but I predict it won’t. If it goes away it won’t be for long and it will grow over time – like most taxes. 3.8% is a starting point. This one has the added political appeal of “taxing the rich” and “unearned income” that makes it more palatable to the electorate.
Nonetheless, there is still benefit to capturing the losses on a tax return.  When you sell a primary residence, up to $500,000 of capital gain for a married couple ($250,000 for a single person) may be excluded.  Unfortunately, rental properties are not awarded this gain exclusion.  Instead, any losses that the property generates over the years can be accumulated and offset with the gain upon disposition.
I wanted these freedoms so I began pursuing a means to have those, which in my case ended up being starting my own company that I could work from anywhere and with no deadlines whatsoever (although the no deadline thing does make things hard sometimes). The income from that company is planned to continue buying more passive income investments so eventually I hit total financial freedom where I can keep living my current lifestyle minus the work part. All of this is called “lifestyle design.”
If you are going to take the after-tax business income out of the company in the year it’s earned, then you’re not enjoying any tax deferral and the loss of the SBD is likely immaterial. If, on the other hand, the after-tax corporate income is retained in the corporation and not paid out as a dividend until a future year, then losing the deferral available on SBD income could be material.
However, while most are familiar with the concept of a passive income rental property, few are actually aware of just how good of an investment they can be. Of course the right property will attract tenants with monthly cash flow, but it is important to note that the benefits of a rental property extend far beyond that of the capital they bring in. In fact, you could argue that the cash flow is an added bonus, coming in a close second to tax benefits. For what it’s worth, the tax benefits associated with a passive income property can very well be the most attractive asset sought out by landlords.
There is a specific tax definition of passive income, known as “passive activity” to the Internal Revenue Service. Passive income is any income you make without actively working or are materially involved. The IRS defines it as any rental activity or any business in which the taxpayer does not “materially participate.” Nonpassive activities, or active activities, are businesses in which the taxpayer works on a regular, continuous, and substantial basis.
A former passive activity is an activity that was a passive activity in any earlier tax year, but isn’t a passive activity in the current tax year. You can deduct a prior year's unallowed loss from the activity up to the amount of your current year net income from the activity. Treat any remaining prior year unallowed loss like you treat any other passive loss.
If any amount of your loss from an activity (as defined in Activities Covered by the At-Risk Rules , later) is disallowed under the at-risk rules for the tax year, a ratable portion of each item of deduction or loss from the activity is disallowed for the tax year. For this purpose, the ratable portion of an item of deduction or loss is the amount of such item multiplied by the fraction obtained by dividing:

But let’s bring them back now. Ok, how do those relate to lifestyle design? Well, I’m assuming we have established that your personal lifestyle design does not involve working, correct? Do you remember which kind of income requires you to work for it? Active income. So then for complete lifestyle design, do you want to have to rely on any active income? No. You only want passive income because passive income doesn’t require much, if any, work on your part. Then you are free to travel or play or watch TV all you want.

Lastly, you’ll need someone to help you create your product. Unless you decide to do this yourself, you’ll need to choose wisely. There are a lot of different choices for finding a graphic designer. Fiverr.com is a cheap option for having someone create a basic icon or other graphic needs starting at $5. 99designs.com is another great option if you want to have multiple graphic designers compete against one another to pitch you their best versions of your idea. 99designs also offers a 100% money back guarantee (which I’ve used), so you have nothing to lose! Upwork.com is good for finding just about everything. You can find graphic designers, app developers, and even marketers. I would stick to a simple graphic designer and app developer. Some teams do both graphic designs and app development, but I personally like to keep those separate. From experience, I’ve gotten better content when I don’t use one-stop-shops.
Secondly, analyze all of the features of your app. Is there anything you can remove? Is this the most simplified version of your initial app idea? Chances are that you can still remove some features. Leave only the essential features of the app. This is very important. You will get your app out to market faster. Which means you will get feedback for your app earlier to improve it and tweak it to meet customer needs. Also, development will be cheaper. It’s better to keep costs down, since you don’t know if your app will be a hit yet.
The activity is a personal service activity in which you materially participated for any 3 (whether or not consecutive) preceding tax years. An activity is a personal service activity if it involves the performance of personal services in the fields of health (including veterinary services), law, engineering, architecture, accounting, actuarial science, performing arts, consulting, or any other trade or business in which capital isn’t a material income-producing factor.
It is helpful to have an understanding of the bigger tax items – basis and depreciation.  Basis is the cost or purchase price of the property minus the value of the land (note: you cannot depreciate land).  The depreciation deduction you can take on residential real estate per year is the basis (cost less land) divided by 27.5.  Depreciation is a great tax deduction you can take every year but will affect your gain or loss when you sell the property.
In most cases, any loss from an activity subject to the at-risk rules is allowed only to the extent of the total amount you have at risk in the activity at the end of the tax year. You are considered at risk in an activity to the extent of cash and the adjusted basis of other property you contributed to the activity and certain amounts borrowed for use in the activity. Any loss that is disallowed because of the at-risk limits is treated as a deduction from the same activity in the next tax year. See Pub. 925 for a discussion of the at-risk rules.
In terms of the returns, peer-to-peer lending can be profitable, particularly for investors who are willing to take on more risk. Loans pay a certain amount of interest to investors, with the highest rates associated with borrowers who are deemed the biggest credit risk. Returns typically range from 5% to 12%, and there's very little the investor has to do beyond funding the loan.
The key here is that income from equipment leasing or rental real estate is generally treated as passive income, with only limited exceptions. Other businesses, including sole proprietorships, partnerships, limited liability companies, and S corporations, produce passive income if the individual taxpayer in question doesn't meet the standard for material participation.
According to NOLO, “the home office deduction is available only if you are running a bona fide business.” That means any work dedicated to your passive income property from the confines of your own home can’t be a hobby. “If the IRS decides that you are indulging a hobby rather than trying to earn a profit, it won’t let you take the home office deduction.”
I love travel photography. I spend a bunch of time on credit card churning and manufactured spending, which allows me to travel the world for virtually free. When I’m on the road, I take my camera with me to generate an additional form of passive income. Not only that I truly enjoy travel photography. It is a great hobby for me. Is hobby income passive or nonpassive income?
There are three main categories of income: active income, passive income and portfolio income. Passive income has been a relatively loosely used term in recent years. Colloquially, it’s been used to define money being earned regularly with little or no effort on the part of the person receiving it. Popular types of passive income include real estate, peer-to-peer (P2P) lending and dividend stocks. Proponents of earning passive income tend to be boosters of a work-from-home and be-your-own-boss professional lifestyle. The type of earnings people usually associate with this are gains on stocks, interest, retirement pay, lottery winnings, online work and capital gains. 
Once your audience has grown and you have validation that you’re offering them value, there are many ways to create passive income. You could sell digital products like ebooks or courses, take up affiliate marketing in which you promote other company’s products and earn a commission when you sell that item to your audience, build a community and charge people to be a part of it, create software and sell that, among other avenues. Ask your audience directly what would serve them best, or look at what they’re saying on Twitter, Facebook or other websites, to find out what problems they have and how you could help solve them.
Passive income, interest, taxable capital gains and certain rents as examples, earned by a CCPC is subject to a high corporate income tax rate of approximately 50%, a portion of which is accumulated in a notional account called the Refundable Dividend Tax On Hand (“RDTOH”). The RDTOH account is a mechanism that is used to simulate for the corporation the highest individual tax rate. In effect, the company “pre-pays” taxes to the federal government and is credited an amount in this pool. The CCPC is therefore entitled to a refund of its RDTOH of $38.33 for every $100 of dividend it pays to its shareholder, regardless of whether the dividend is sourced from the income it has generated from its active business or from its passive income. The refund is triggered at the time the dividend is paid since at this point the shareholder herself will now pay income taxes on that dividend earned. The RDTOH account is therefore used to achieve the integration at the corporate level by taxing passive investment income at roughly the top personal tax rate while it’s retained within the corporation.
Peer-to-Peer Lending: Earn up to 10% in returns by lending individuals, organizations and small companies who don't qualify for traditional financing through peer-to-peer lending platforms like Lending Club. You can lend $100, $1,000, or more to borrowers who meet lending platform financial standards. Like a bank, you'll earn interest on the loan - often at higher returns than banks usually get.

Virtual assistants can do anything that doesn’t require a physical presence: Scheduling appointments, making calls, sending emails, creating and processing invoices and general project management can all be done virtually. And tasks beyond administrative work are possible, too: Virtual assistants can be trained for customer prospecting and other key business operations.
